Return and Refund Policy

This Return and Refund Policy describes how Autom8 Technologies Inc. (“Autom8”, “we”, “us”, or “our”) handles returns, exchanges, and refunds for purchases made directly from Autom8 through our online store and related sales channels (the “Store”).
This policy applies in addition to any rights you may have under applicable consumer protection laws in your country of residence. Where this policy conflicts with mandatory local law (including EU/EEA and UK rules on consumer rights and distance contracts), the law will prevail.
1. Scope and definitions
This policy covers purchases made directly from Autom8 of:
- Hardware products, such as Autom8 OBD devices and any accessories we may offer from time to time (together, “Devices”); and
- Digital products and services, including software licences, credits, subscriptions, and tuning-related or platform services delivered through the Autom8 platform (web dashboard and mobile apps) (“Digital Services”).
If you bought an Autom8-branded product or service from an authorised dealer, shop, or other reseller, please see section 5 below.
2. General rule – all sales are final (change-of-mind)
Except as expressly set out in this policy or required by applicable law:
- All sales are final.
- We do not accept returns or provide refunds for:
- Change of mind
- Ordering the wrong product or quantity
- Deciding you no longer want or need the Device or Digital Service
This does not affect your statutory rights under applicable consumer law, including:
- Rights relating to defective or non-conforming products, and
- For consumers in the EU/EEA and UK, any mandatory cooling-off / withdrawal rights for distance contracts (see section 4.3).
3. Devices purchased directly from Autom8 – defective, damaged, or incorrect
We will still deal with Devices that are defective, damaged, or not as described.
3.1 Defective, damaged, or incorrect on arrival (DOA)
If a Device you purchased directly from Autom8:
- Arrives defective,
- Arrives damaged in transit, or
- Is not what you ordered (wrong model/item),
please contact us at admin@autom8-obd.com as soon as reasonably possible, and in any event within 14 days of delivery, with:
- Your order number
- A description of the issue
- Photos or video showing the damage/defect where possible
Where we confirm a defect, damage, or incorrect shipment, we will, at our discretion and in line with applicable law:
- Repair the Device (where appropriate), or
- Replace the Device, or
- Issue a refund of the purchase price, including standard shipping where required.
We may ask you to return the original Device before sending a replacement or issuing a refund. We will usually bear reasonable return shipping costs or provide a prepaid return label in these cases.
Your statutory rights regarding defective goods (including any mandatory legal warranty in your country, such as EU/EEA/UK legal conformity guarantees) are not affected by this internal 30-day process.
4. Digital Services, licences and credits
4.1 All sales final for Digital Services
As a baseline, all sales of Digital Services are final and non-refundable, except where:
- Required by applicable law, or
- We choose to offer a goodwill refund at our sole discretion.
This includes, for example:
- Licences and credits
- One-time tuning or file services
- Subscriptions or usage-based services, once the period has started
4.2 Used or activated Digital Services
Once a Digital Service has been:
- Used to flash a vehicle or perform a tuning action,
- Redeemed or applied to an account, module, or vehicle, or
- Otherwise consumed or unlocked in the Autom8 platform,
the purchase is non-refundable, except where required by law or where a clear technical fault on our side prevented you from using what you purchased.
We may verify whether a given licence, credit, or file has been used or activated before considering any remedy.
4.3 EU/EEA and UK consumers – withdrawal rights for Digital Services
If you are a consumer located in the EU/EEA or UK, you may have a statutory 14-day right of withdrawal for certain digital services and content purchased at a distance.
However, under EU/UK law, you can lose that right early if:
- You explicitly request that we start supplying the Digital Service before the end of the 14-day withdrawal period, and
- You acknowledge that you will lose your right of withdrawal once we begin performance.
We may implement this by asking you to confirm, at checkout or in-app, that:
“I request immediate performance of the digital service and acknowledge that I will lose my statutory right of withdrawal once performance has begun.”
Where you have given this consent and we have started providing the Digital Service (for example, where a licence/credit has been provisioned or a file has been made available for flash), you will generally not have a right to withdraw from that specific digital purchase, except in situations where the law still grants you such a right.
5. Purchases from dealers, shops, or other resellers
This policy applies only to purchases made directly from Autom8 (for example, via our official online Store).
If you purchased an Autom8 Device or any related service from an authorised dealer, shop, installer, or other third-party reseller:
- Your contract of sale is with that dealer or reseller, not directly with Autom8.
- Your return and refund rights are governed by that dealer or reseller’s own policies and by the laws that apply to them.
- You must contact the dealer or reseller directly to request returns, refunds, or exchanges, unless we specifically direct you otherwise.
We may still provide manufacturer support or warranty handling for defects as permitted by our agreements with dealers and applicable law, but the dealer’s returns/refunds policy will generally control the relationship between you and them.
6. How to request a remedy (for direct purchases)
If you bought directly from Autom8 and believe you are entitled to a repair, replacement, or refund under this policy or applicable law:
- Email admin@autom8-obd.com with:
- Your full name
- Order number
- Clear description of the issue
- Any relevant photos or videos (for Devices)
- We will review your request and may ask for additional information.
- If we determine that a repair, replacement, or refund is appropriate, we will give you instructions for return (if required) and next steps.
You must follow any reasonable instructions we provide to process your request.
7. Return shipping costs (for direct purchases)
Unless otherwise required by law:
- If the Device is defective, damaged on arrival, or we shipped the wrong item:
- We will bear reasonable return shipping costs or provide a prepaid return label where possible.
- In other situations where a return is accepted (for example, where local law gives you a withdrawal right):
- You may be responsible for return shipping costs and any customs, duties, or fees associated with the return, unless applicable law requires us to cover them or we have agreed otherwise.
We recommend using a tracked shipping method; we are not responsible for returned items that are lost in transit.
8. Chargebacks and disputes
If you initiate a chargeback with your payment provider without first contacting us, we may:
- Pause investigation of your issue while the payment provider’s process runs, and/or
- Suspend or terminate access to the relevant Services or account, in accordance with applicable law and our Terms of Service.
We strongly encourage you to contact us at admin@autom8-obd.com first so we can attempt to resolve any problem directly.
9. No limitation of mandatory consumer rights
Nothing in this Return and Refund Policy is intended to limit or exclude any non-waivable rights you may have under applicable consumer protection laws, including:
- Legal guarantees regarding defective or non-conforming goods
- Mandatory cooling-off / withdrawal rights for consumers in the EU/EEA and UK
- Any additional rights granted by the laws of your country of residence that cannot be contractually excluded
In the event of any inconsistency between this policy and such mandatory rights, those rights will prevail.
